About the Camp Lejeune Water Contamination Lawsuits
The drinking water supply at a particular United States Marine Corps (USMC) Base Camp Lejeune in Jacksonville, NC, was contaminated with toxic volatile organic compounds (VOCs) which were hundreds of times higher than what is safe for human consumption, including:
- Trichlorethylene (TCE) – this solvent is used to clean metal parts, and is classified as a cancer causing chemical.
- Tetrachloroethylene (aka perchloroethylene (PCE)): For dry cleaning and degreasing of metals. Levels charted over 43x the safe level, and this chemical is likely the worst of the culprits.
- Vinyl chloride (VC) – over time, TCE and PCE in the groundwater degrade and become VC.
- Benzene: a chemical that is often used to other chemicals that compose plastics, resins, and nylon and synthetic fibers.
- Mercury: Compounding other issues, in 2012, the Hadnot Point water facility was also found to be utterly contaminated with mercury, which could have come from the pressure meters used at the facility which were removed in the 1980s.
Benzene, TCE, and VC are all classified as cancer-causing chemicals, while PCE is classified as probably carcinogenic. Exposure to these chemicals can also increase the risk of birth defects and other health problems. PCE can be absorbed orally, via inhalation, and through skin contact. PCE targets the central nervous system, liver & kidneys, and ultimately binds to and accumulates in fat cells. PCE can also cross the placenta barrier, meaning this chemical can and does affect fetal development, which lead to many birth defects of children born at Camp Lejeune.
It being utterly clear and indisputable, the Environmental Protection Agency (EPA) placed Camp Lejeune on the “CERCLA” (Comprehensive Environmental Response, Compensation and Liability Act of 1980)
North Carolina’s “Statue of Repose” law had put a maximum year limited on how long one could wait before filing a civil law suit, which blocked people who could not have known that they were exposed to toxic water until long after the deadline was passed from being able to seek justice, but subsequently new laws and statues have been enacted that has changed much of the likely outcome. Even with the passage of the Janey Ensminger Act which authorized the United States Government to pay for the costs of medical care which was a baby step in 2012, little seemed to be changing that made it look like those harmed by the toxic water at Camp Lejeune would be able to get justice. Many of the victims simply went on disability and suffered.
However, in June of 2022, the Camp Lejeune Justice Act of 2021 was passed, which was part of the more broad “Honoring our Promise to Address Comprehensive Toxics (PACT) Act. The PACT Act focuses on addressing issues that affect veterans exposed to toxic materials during service, wiht the CLJA affecting specifically those stationed at Camp Lejeune from August 1st of 1953 through Dec 31st of 1987.
This new law circumvents the North Carolina statues, and makes all of those exposed to the toxic chemical eligible to file suit and seek restitution.
