The certified class action alleges that Solar Brokers misclassified a substantial portion of their workforce as contractors when they ought to have been classified as employees, they also systemically pushed the workers to work uncompensated overtime.
The class has been certified as a class action, the opt-out period ended on February 26, 2020. The corporate defendant was noted in default on April 26, 2021.
Updates February 7, 2024:
On November 23, 2023, a settlement agreement was reached with one of the individual defendants. The Settlement Agreement can be found here. The Settlement approval hearing is scheduled for June 28, 2024 before the Superior Court of Justice at 10 am over Zoom.
The Ontario Superior Court of Justice issued on February 6, 2024 the Dissemination Order for the Settlement Approval Hearing. The order can be found here.
